These Terms of Service (“Terms”) govern your access to and use of Prompt Book Club (the “Site”), including any content, features, newsletters, and related services (collectively, the “Services”). The Site is operated by Guthrie Blackwell & Co. LLC (“we,” “us,” “our”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1) Eligibility
You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with consent of a parent or legal guardian.
2) Your Use of the Site
You agree not to:
- violate any law or regulation;
- interfere with the Site’s operation or security;
- attempt to access non-public areas or systems;
- scrape, copy, or reuse content in bulk without permission;
- use the Site to transmit harmful, offensive, or abusive content.
We may suspend or terminate access if we believe you are misusing the Services.
3) Educational and Informational Use Only
The Site provides educational and informational content about books, ideas, prompts, and practical AI usage. Nothing on the Site is professional advice (legal, medical, financial, or otherwise). You are responsible for how you use any information, prompts, or examples.
AI outputs can be inaccurate or incomplete. Always verify important information and use your judgment.
4) Intellectual Property
All content on the Site (including text, prompts, graphics, logos, and design) is owned by us or our licensors and is protected by intellectual property laws.
You may:
- read and share links to our content; and
- quote short excerpts with attribution and a link back to the original page.
You may not:
- reproduce, distribute, sell, or create derivative works from our content without written permission, except where allowed by law.
5) User Submissions (If Applicable)
If you submit comments, feedback, emails, or other materials (“Submissions”), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify (for formatting/clarity), and display those Submissions to operate, improve, and promote the Services.
You represent that you have the rights to submit the material and that it does not violate any rights or laws.
6) Newsletter and Email
If you subscribe, you consent to receive emails from us. You can unsubscribe anytime using the link in the email. We may use third-party providers to send emails and manage subscriptions.
7) Purchases and Digital Products (If/When Offered)
If we offer paid products (e.g., digital prompt packs, templates, or subscriptions), additional terms may apply at checkout.
Unless otherwise stated:
- Digital products are non-refundable once delivered or accessed, except where required by law.
- You may not share, resell, or redistribute paid materials.
8) Third-Party Links and Services
The Site may link to third-party websites or tools (including AI platforms). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.
9) Copyright Complaints
If you believe content on the Site infringes your copyright, contact us with:
- identification of the work claimed to be infringed,
- the URL of the allegedly infringing material,
- your contact information,
- a statement you have a good-faith belief the use is unauthorized,
- a statement under penalty of perjury that your notice is accurate,
- your physical or electronic signature.
10) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee the Services will be uninterrupted, secure, or error-free.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS, WHICHEVER IS GREATER.
12) Indemnification
You agree to defend, indemnify, and hold harmless Guthrie Blackwell & Co. LLC from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your Submissions, or your violation of these Terms.
13) Changes to the Services or Terms
We may update the Services or these Terms from time to time. The “Last updated” date reflects the latest revision. Your continued use after changes means you accept the updated Terms.
14) Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules.
